Frequently asked questions: Payment reminder

There is no legally prescribed number of such letters. It is customary to send a payment reminder, a formal reminder and a final reminder threatening debt enforcement proceedings. You can then initiate debt enforcement proceedings at the debt enforcement office in the debtor’s place of residence (Art. 46 SchKG).

If a claim is due, the debtor is in default upon receipt of the reminder (Art. 102(1) OR). If a fixed payment date has been agreed, default occurs as soon as that date expires (Art. 102(2) OR). From the moment default occurs, the debtor owes default interest at a rate of 5 per cent per annum (Art. 104 of the Swiss Code of Obligations).

Only if they are contractually agreed, for example in the terms and conditions. Without such an agreement, you may charge the statutory default interest of 5 per cent from the date of default. Our reminder therefore does not charge any flat-rate fees.

CHF 13.90 via A-Post Plus with a tracking number or CHF 17.90 by registered post – including printing, envelope, postage, dispatch and the enclosed invoice.

Yes, this is recommended. Registered post provides proof of delivery against signature. This allows you to prove, in debt enforcement or court proceedings, that the debtor was served with a reminder.
